Hi all,
I just wanted to jump in here and point out two items:
1 - We do not and will not allow discussions of counterfeit bags.
2 - However, replica bags (true replica's, not counterfeits) are not illegal.
The question is where is the line between replica vs. counterfeit.
From the limited legal research I have done, counterfeit occurs when either a copyright logo or brand name is used on the bag.
Having a bag that otherwise looks similar to a brand name bag, but without any brand name or logo, is a replica and is legal.
I have not had time to read this thread or other threads in this forum so I don't know whether this line is being crossed here or not.
I also don't know whether the forum can keep a clear line between replica bags and counterfeits since it can come down to a tag or logo being present or not.
So, we may end up simply banning all discussion of replicas as well simply because it is too difficult to police....but then we are also quashing discussion of legal goods.
Anyway, those are the issues and it is not as clean cut as many people apparently think (i.e. not all replicas are illegal).
I am hoping to talk with our IP attorney this week to ensure we have the proper guidelines and then we'll decide how to implement here. I'll also have to read through these posts to see what is being discussed/promoted as well.
The short summary is that it is being worked on, and no we will not allow discussion of illegal goods...but the line between legal and illegal is not nearly as clean cut.
Best regards
